Terms of Service

The Shipping Dude is a platform to compare and buy shipping labels from carriers. We are an intermediary: we don't deliver anything ourselves, and every shipment also follows the carrier's own rules. Follow those rules and ours, and we'll get along fine.

1. Agreement Between You and The Shipping Dude

These Terms of Use ("Terms") are an agreement between you and The Shipping Dude ("The Shipping Dude", "we", or "us"). They apply to our website, dashboard, integrations, and any other channel we or our support team operate (together, the "Sites"). When you create an account or use the Sites, you accept these Terms.

Please read them carefully. They limit our liability, waive class actions, and require most disputes to go to individual arbitration. They sit alongside our Privacy Policy and Refund Policy, which explain how we handle your data and your money.

2. Who Can Use the Service

By using the Sites you confirm that you:

  • Are at least 18 years old and able to form a binding contract. If you sign up for a company, you confirm you may bind that company, and "you" includes both you and the company.
  • Will use the Sites only to buy carrier services for lawful shipments, either your own or those of someone you are authorized to act for.
  • Will follow all applicable laws, including export and import controls, controlled-substance and hazardous-materials rules, and each carrier's own rules.
  • Have not previously been suspended or banned from The Shipping Dude.

3. What We Do

The Shipping Dude is a platform for comparing rates from carriers such as USPS, UPS, and FedEx, buying shipping labels, tracking shipments, importing orders from connected stores, and managing your shipping history and wallet (the "Services"). The Services are for lawful shipping only.

Some features depend on your plan. For example, UPS and FedEx rates are part of the Business plan, and plan features may change over time.

4. We Are an Intermediary, Not a Carrier

We resell postage and labels from carriers. We do not pick up, transport, or deliver anything, and showing a carrier or service does not mean we endorse it or guarantee its quality or availability.

Your shipment is governed by the carrier's own terms. Risk of loss passes to you when the carrier takes the package. You are responsible for reading and accepting each carrier's terms, including prohibited items and packaging rules, and for filing any claim for lost or damaged shipments with the carrier. For example, the first time you buy UPS or FedEx labels you may be asked to accept that carrier's terms.

We are not responsible for the acts, delays, errors, or negligence of any carrier. If a carrier hands us a package that is undeliverable or cannot be returned, we may dispose of it or handle it as the law allows, without liability to you.

5. Connected Stores and Third-Party Sites

You can connect stores and marketplaces such as WooCommerce, Shopify, and Amazon to import orders and send back tracking details. We do not control those platforms, their APIs, or the data you keep on them, so we are not responsible for lost or incorrect data, downtime, or changes on their side. Your use of any third-party site is governed by that site's own terms and privacy policy.

6. Availability and Changes

We work to keep the Sites running, but we may pause them for maintenance or other reasons and do not promise uninterrupted access. We may update these Terms as our services or the law change. We will post the new version with a new date and may also notify you by email or inside the dashboard. If you keep using the Sites after the effective date, you accept the updated Terms; if you disagree, your only remedy is to stop using the Sites. Features with their own rules may come with additional terms, which apply together with these Terms.

7. Feedback and Conduct

We welcome your ideas. If you send us feedback, we may use it freely without paying you or keeping it confidential, and you confirm it does not infringe anyone's rights.

Our support team is here to help, and we expect respectful treatment in return. We may restrict or end service for anyone who is abusive toward our staff. Support conversations may be recorded or kept in writing, as described in our Privacy Policy.

8. Accounts, Security, and Identity Checks

Some features need an account. Keep your login details private; you are responsible for all activity under your account, with or without your knowledge, and must tell us right away at support@theshippingdude.com if you suspect unauthorized use. We may reject or require changes to credentials.

To protect the platform from fraud, we may ask you to verify your identity through a third-party provider before you can use certain features, such as enabling UPS or FedEx or buying labels. We may require this at our discretion, and we may restrict features until it is completed.

9. Payments, Wallet, and Additional Charges

You agree to pay all charges for the Services when you order them. The Shipping Dude runs on a pre-funded wallet: you add credit, and label purchases are deducted from it. You confirm you are allowed to use any payment method you provide and that your payment and contact details are accurate and current.

Card payments are processed by our payment provider. Business plan accounts may fund their wallet only with non-prepaid credit or debit cards; prepaid and gift cards are not accepted for Business accounts and any such payment may be declined or refunded. We may also accept other methods such as bank wire or digital payments, which are subject to review before credit is applied.

If a payment is declined, reversed, or disputed, you are responsible for the amount plus any bank, processor, and reasonable collection costs, and we may recover it from any payment method on your account.

You are also responsible for extra charges that arise from your shipments, including those caused by wrong weight, size, or class; weekend or holiday delivery; customs, duties, or taxes; and carrier surcharges or address corrections. If a carrier bills us for these, we may deduct them from your wallet or payment method, or you must reimburse us within seven (7) days of our request. We are not obliged to refund or reduce charges caused by information you entered incorrectly.

Refunds for unused or misprinted labels are handled under our Refund Policy and must be requested within the time stated there. If a refund is approved, we will credit your wallet, and you assign to us your right to claim that amount from the carrier.

10. Wallet Balances

Your wallet balance and transaction history are available in your dashboard. We track your balance but do not hold it in a separate bank account and do not pay interest on it. Refunds of unused balances are handled under our Refund Policy and subject to your bank's or payment provider's procedures.

If we cannot reach you for a long period, we may treat your account as abandoned and, where the law requires, report and transfer any remaining balance to the relevant state unclaimed-property authority.

11. Changes to Pricing and Policies

We may change prices, markups, promotions, billing practices, and policies at any time. Changes are posted on the Sites, and continuing to use the Services means you accept them. Carrier rates may change at any time and discounts are limited to shipments from the United States.

12. Monitoring, Suspension, and Termination

We may monitor the Sites and remove content. You can close your account any time by contacting support. We may suspend, restrict, or terminate your account or access, with or without notice, including for misconduct, illegal use, abuse of our staff, suspected fraud, or violation of these Terms.

On termination you must pay any outstanding amounts. Our rights to damages and indemnity, and any terms that by nature should continue, survive. We may keep your information as described in our Privacy Policy, and any remaining wallet credit is handled under our Refund Policy.

13. Our Proprietary Rights

The Sites, the Services, and the software behind them contain proprietary information protected by intellectual property law. Using the Services does not transfer any ownership to you. All content on the Sites, including The Shipping Dude name, logos, and the look and feel of our pages, belongs to us or our licensors, and you may not use our marks or style without our written permission.

Carrier names, logos, and marks, such as those of UPS, USPS, and FedEx, belong to their owners and appear only to identify their services.

14. Your Use of the Sites

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the Services and content for your own shipping needs. You may not, or attempt to:

  • Copy, modify, or create derivative works of the Sites or their content, or remove any ownership notices.
  • Reverse engineer, decompile, rent, resell, or sublicense the Sites or software.
  • Access the Sites by any means other than the interfaces we provide.
  • Bypass, disable, or interfere with security, authentication, or the operation of our systems.
  • Use the Services for anything illegal or prohibited by these Terms, including shipping prohibited or restricted items or creating fraudulent shipments or abusing carrier pricing.
  • Upload malicious code, or content that is unlawful, harassing, defamatory, or that you have no right to provide.
  • Scrape, crawl, or use bots or automated tools to extract data from the Sites. Violations may lead to immediate suspension.

16. Disclaimer of Warranties

The Sites and Services are provided "as is" and "as available". To the fullest extent the law allows, The Shipping Dude, its affiliates, and their officers, employees, agents, licensors, and service providers (the "Shipping Dude Parties") make no warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, or security. Nothing we say creates a warranty.

Information on the Sites, including carrier rates and service descriptions, may contain errors, and we may correct pricing mistakes. Some places do not allow certain exclusions, so parts of this section may not apply to you.

17. Limitation of Liability

You use the Services at your own risk. To the maximum extent permitted by law, the Shipping Dude Parties will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or business, arising from your use of or inability to use the Sites or Services, from delays or failures in the Services, or from the acts or omissions of a carrier or other provider, whatever the legal theory.

Our total liability to you for any claim is limited to the amount you paid us in the 90 days before the claim arose. Having more than one claim does not increase this limit. Nothing in these Terms limits liability that cannot be limited by law, such as for fraud or personal injury.

Any claim must be started within one (1) year after you first knew, or should have known, of the event giving rise to it, unless the law prohibits this limit.

California residents: you waive California Civil Code Section 1542, which says a general release does not cover claims the releasing party does not know or suspect exist when the release is made.

18. Indemnity

To the extent the law allows, you will defend, indemnify, and hold the Shipping Dude Parties harmless from any claim, loss, or expense, including reasonable legal fees, arising from your breach of these Terms, your use of the Sites or Services, or your violation of any law or third party's rights. You will cooperate in the defense, we may control it at our own cost, and you will not settle without our written consent.

19. Class Action Waiver

You waive any right to bring or take part in a class action against the Shipping Dude Parties. You agree not to bring claims as a class or representative action, to combine your claims with other people's, to be represented in someone else's class action, or to seek relief on behalf of anyone who is not a named party.

20. Governing Law

These Terms are governed by the laws of the State of New Jersey, United States, and by U.S. federal law including the Federal Arbitration Act, without regard to conflict-of-law rules.

21. Use Outside the United States

We are based in the United States and the Services are intended for people and businesses in the United States. If you use the Sites from elsewhere you are responsible for following local law, and you agree your information may be transferred to and processed in the United States. You may not use the Services if you appear on a U.S. government restricted-party list, are in an embargoed country, or would be violating U.S. export laws. We may limit availability in any place at any time.

22. Dispute Resolution and Arbitration

By agreeing to these Terms, you and we give up the right to sue in court, except that either of us may bring an individual claim in small claims court if it qualifies. All other disputes about these Terms, the Sites, or the Services must go through the steps below.

Step 1 — Informal resolution. The party raising a dispute must first send written notice. If you are the one raising it, email support@theshippingdude.com with your name, your account email and address, your lawyer's details if any, and a short description of your claim and what you want. If we are raising it, we will email the address on your account. Within sixty (60) days of the notice we will hold a confidential video or phone call to try to settle it in good faith. Sending the notice pauses any time limit, and completing this step is required before arbitration.

Step 2 — Binding arbitration. If the dispute is still unresolved, it will be decided by confidential, individual, binding arbitration in English in the State of New Jersey, under the commercial rules of the American Arbitration Association (AAA) or JAMS, before a single arbitrator chosen by both sides. The costs are shared equally, though the prevailing party may recover reasonable attorneys' fees. The arbitrator may not award punitive damages. The decision is final and may be enforced in any court with jurisdiction.

Either side may still ask a court in New Jersey, or any other court of competent jurisdiction, for an injunction or other urgent relief.

23. General Terms

Nothing in these Terms makes you our employee, agent, or partner. You may not transfer your rights or duties under these Terms without our written approval. If any part of these Terms is found unenforceable, it will be applied as closely as the law allows and the rest stays in force. These Terms, any additional terms, and our Privacy Policy are the whole agreement between us on this subject. A waiver only counts if it is in writing from us, and not enforcing a right once does not waive it later. "Including" means "including without limitation".

24. Carrier Notices

Discounted carrier rates apply to shipments from the United States only and may change at any time without notice.

Carrier tracking systems and the tracking information they provide are the private property of the relevant carrier. You may use them only to track shipments you send with that carrier, and may not republish, copy, store, or sell that information for commercial gain without the carrier's written consent. This is a personal service and your right to use it cannot be transferred.

25. Notices and Contact

We may give you notices by any lawful method, including email to the address on your account or a message on the Sites. Please keep your contact details current and check for notices. Questions about these Terms can be sent to support@theshippingdude.com.
